No Liability for Third-Party Claims: We shall not be liable for any claims, damages, losses, liabilities, costs, or expenses arising from third parties related to client use of developed solutions, including but not limited to claims from end users, customers, regulatory authorities, or other stakeholders.
Indemnification: Clients agree to indemnify, defend, and hold harmless Webstume, its officers, directors, employees, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to client use, misuse, or operation of developed solutions.
Project Scope Limitations: Our liability is limited to the scope of work explicitly defined in written project agreements. We are not responsible for features, functionality, or requirements that fall outside the agreed project scope, unless explicitly agreed upon in writing.
Business Impact Disclaimer: We make no representations or warranties regarding business outcomes, financial results, market performance, user adoption, or any other business metrics resulting from the use of developed solutions. Clients are solely responsible for their business results.
Third-Party Services and Integrations: We are not responsible for the availability, functionality, compliance, or legal status of third-party services, APIs, platforms, or integrations that may be used in or with developed solutions. Clients are responsible for ensuring compliance with third-party terms of service.
Intellectual Property Claims: While we develop original code and solutions, we are not responsible for claims of intellectual property infringement related to client-provided content, specifications, requirements, or third-party components. Clients warrant that they have proper rights to all materials provided.
Data and Content Responsibility: Clients are solely responsible for all data, content, and information used in, stored by, or processed through developed solutions. We are not responsible for data breaches, data loss, privacy violations, or content-related legal issues.
Maximum Liability Limitation: To the maximum extent permitted by law, our total liability for any claims arising from or related to our services shall not exceed the total amount paid by the client to us for the specific project giving rise to the claim.
